By accessing or using the Serleaf platform (the "Platform"), including our website, applications, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

These Terms constitute a legally binding agreement between you and Serleaf ("we", "our", or "us"). We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email.

2. Description of Service

Serleaf is a hospitality recruitment platform that connects resorts, hotels, and hospitality businesses ("Employers") with job seekers ("Candidates"). Our services include job posting and listing, candidate profile creation and management, application processing, communication tools, and related recruitment features.

3. User Accounts

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• You may not create multiple accounts or share your account with others.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Employer Obligations

If you use the Platform as an Employer, you agree to:

• Post only genuine job opportunities with accurate descriptions and requirements.
• Comply with all applicable employment and anti-discrimination laws.
• Handle candidate data in accordance with applicable data protection laws.
• Not use candidate information for purposes other than recruitment.
• Respond to applications in a timely and professional manner.
• Maintain accurate and up-to-date company information on the Platform.

5. Candidate Obligations

If you use the Platform as a Candidate, you agree to:

• Provide truthful and accurate information in your profile and applications.
• Not misrepresent your qualifications, experience, or credentials.
• Not apply for positions you are clearly unqualified for in bulk.
• Maintain up-to-date profile information.
• Communicate professionally with potential employers.

6. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms.
• Post false, misleading, or fraudulent content.
• Scrape, crawl, or use automated means to access the Platform without authorization.
• Attempt to gain unauthorized access to other users' accounts or Platform systems.
• Transmit any malware, viruses, or harmful code.
• Harass, threaten, or discriminate against any user.
• Post content that infringes on intellectual property rights of others.
• Use the Platform to send spam or unsolicited communications.
• Circumvent any security or access controls of the Platform.

7. Intellectual Property

The Platform, including its design, features, content, and technology, is owned by Serleaf and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose. You retain ownership of content you submit to the Platform but grant us a worldwide, royalty-free license to use, display, and distribute such content in connection with providing our services.

8. Fees and Payment

Certain features of the Platform may be subject to fees. All fees are as stated on the Platform at the time of purchase. Fees are non-refundable unless otherwise stated. We reserve the right to change our pricing with reasonable notice. Employers are responsible for any applicable taxes on services purchased.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We do not endorse or guarantee the accuracy of any job posting or candidate profile. We are not responsible for any employment decisions made through the Platform.

10. Limitation of Liability

To the maximum extent permitted by law, Serleaf shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Serleaf, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately, though certain provisions of these Terms survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE, unless otherwise required by applicable consumer protection laws.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
